Stunt Gym & Fitness Liability Waiver

Safety Regulations: Certain restrictions are enforced for the safety of all participants at our facility. By visiting our premises, you agree to adhere to the following safety regulations:

No running.
Limited jumpers in designated areas.
No unsupervised flips or tumbling.
No unsupervised stunting.
No misuse of equipment.
Remain aware of others, physical limitations, and age-restricted areas.

Assumption of Risk and Indemnification: By participating in any activities or services offered by Stunt Gym/Not Your Average Services, LLC, including but not limited to those outlined in this waiver, you acknowledge and assume all risks, including exposure to infectious diseases like MRSA, influenza, and COVID-19. You also agree to hold harmless and release Stunt Gym/Not Your Average Services, LLC, Serenity Living Transitional Home, Balk Brothers LLC, Ashley Moorefield, Shawn Moorefield, and its associates, staff, independent contractors, or volunteers from any liability for illness, disability, injury, death, or property damage.

Consent to Arbitration and Venue: Any disputes arising from this agreement or related activities shall be resolved through mediation and non-binding arbitration administered by the American Arbitration Association. The venue for any legal proceedings shall be in the county/parish and state where the premises are located.

Consent to Receive Automated Text Messages: By providing your phone number, you can receive SMS text messages from Stunt Gym/Not Your Average Services, LLC regarding programs, offers, and other information. You may decline to receive automated messages anytime by responding with STOP.

Liability, Fees, and Agreement Terms:

Liability for Property: Stunt Gym/Not Your Average Services, LLC is not liable for any personal property damaged, lost, or stolen on the premises, including vehicles, locker contents, or other belongings, regardless of negligence.
Attorneys' Fees: I promise to indemnify and pay Stunt Gym/Not Your Average Services, LLC, for any attorneys’ fees and costs incurred to enforce this agreement's mediation and non-binding arbitration portion.
Photo Release: By entering the premises, I grant Stunt Gym/Not Your Average Services, LLC, the right to photograph and record me and my guests, waiving any right to inspect or approve the use of the media.
Terms of Agreement: This agreement extends indefinitely and applies to all visits to Stunt Gym/Not Your Average Services, LLC locations. It is intended to be as broad as permitted by law. It is in effect for a lifetime unless written notification is sent revoking your waiver agreement.
Mediation, Non-Binding Arbitration, and Venue: Disputes related to this agreement, activities, or incidents on the premises may be settled through mediation and non-binding arbitration administered by the American Arbitration Association. The venue for legal proceedings shall be determined based on the location of the premises.

Not Your Average Services, LLC and Stunt Gym Release Agreement:

For the right to engage in activities at Stunt Gym and Not Your Average Services, LLC’s premises (the “PREMISES”), including trampoline access, fitness classes, cheer, boxing, martial arts, dance, and gymnastics equipment, aerial training, rock climbing, and other activities, provided by Not Your Average Services, LLC, guests, and associated entities, on behalf of myself and my associates, hereby:

Agree to inspect the premises upon entry or participation. (b) Acknowledge that entry into the premises signifies acceptance of their safety and suitability for use. (c) Confirm good health and physical fitness for participation in activities. (d) Certify that neither I nor my associates will participate under the influence of alcohol or drugs impairing safety. (e) Affirm no advisement against activities by a health professional. (f) Acknowledge voluntary participation in activities. (g) Commit to participating only in activities of sufficient skill level to avoid injury. (h) Accept sole responsibility for determining fitness for activities. (i) Agree to abide by activity rules given verbally, posted at the premises, or related website. (j) Accept responsibility for our actions and equipment condition while participating.
By signing this document, I confirm that I have read and understood the terms of the release of liability and assumption of risk agreement. I acknowledge that I sign it freely and voluntarily, without any inducement.

I hereby acknowledge this release from liability for accidental injury or illness that I may incur as a result of participating in any physical activity. I hereby assume all risks connected therewith and consent to participate in this program. I agree to disclose any physical limitations, disabilities, ailments, or impairments that may affect my ability to participate in this program. I declare that the info I’ve provided is accurate & complete. I listed patients who have been medically cleared for a high level of physical activity. I declare that I am the legal guardian of all listed minors.
